I've been waiting for the attorney general for DC. Under District of Columbia involuntary manslaughter statute, whoever is guilty of manslaughter will be sentenced to a period of imprisonment up to 30 years.

Involuntary, Misdemeanor Manslaughter: elements are:

* Defendant caused the death of the victim;

* Defendant did so while committing or attempting to commit an underlying misdemeanor; and

*Defendant committed or attempted to commit the underlying misdemeanor in a manner that created a reasonably foreseeable risk of appreciable physical injury.

A foreseeable risk of appreciable physical injury exists when physical injury is a possible consequence of the crime that is committed or attempted. Intent to kill does not need to be proven.

6. people died as a result of the insurrection. So far, approximately 450 defendants have pleaded guilty of have been convicted of at least a misdemeanor. What about those who planned and executed the insurrection?

Former US attorney Glenn Kirschner covered this (elements of homicide) in detail, with respect to 300,000 excess COVID deaths, on Brian Tyler Cohen's podcast a day or tow ago.

Long story short: guilty, guilty guilty!

Greg, Glen Kirschner's example of the robber chasing his victim into the street, causing the victim to be hit and killed by a car, so clearly illustrated involuntary manslaughter for me. It certainly matches the Orangenstein's inaction and malicious actions at the start of the pandemic.

The way it was described sounds more like voluntary manslaughter to most of us, but Kirchner says this is classified as involuntary manslaughter.

I don't know about COVID. Would require a battle of experts as to the science and as to causation, which just means if death was aggravated or exacerbated by COVID, which has an RNA marker. If true then can use the Florida involuntary manslaughter statute to charge De Santis.

Kirschner was chief prosecutor for DC, city of Washington.

In some of the convictions, defendants alleged that they were induced to come to the Capitol by Trump and also some were subsidized (their expenses and even legal fees) by some alter ego. Intent can be inferred by conduct.

I didn't discuss the felony murder rule in DC. It's complicated. I don't think a prosecutor can prove that all of the insurrectionists who breeched the capitol had the same state of mind -- same mens rea. The Model Penal Code recognizes four different levels of mens rea: purpose (same as intent), knowledge, recklessness and negligence. These can be sorted out on a case by case basis....

For the people actually taking part in the insurrection, it should be on a case by case basis, which it has been. But what about the planners, organizers & inciters, who purposefully enticed these people to the Capitol, knowingly putting a lot of people in harm's way? If conspiracy to commit sedition can be shown that ended in the loss of lives, could the perpetrators reasonably charged with involuntary manslaughter?

Just listened to a former prisecutor Glenn Kirshner’s Podcaet on YouTube, explaining three characteristics of “involuntary manslaughter.” . Trump, Kushner, and Pence, according to Kirshner, are all culpable for their failure to safely guide the public through COVID-19.

I am beyond impatient waiting for justice to be served for all of the offenses committed on January 6th. Loss of citizenship is my favorite penalty .... only to be regained after class attendance in Constitutional Law and proven understanding of the laws most of us obey. As a teacher when I found two students physically fighting I gave them (heavy) boxing gloves and forced them to fight without spectators. The combatants always became friends. Insurrectionists know they were lawless and should be swiftly punished. Where is the justice arm of our government? Can we make it clear that criminal acts are not constitutional rights?

image.pngThis is a true story, if it wasn't, the picture seen above wouldn't be possible. The male Betta in all his glory. The female has shorter fins with a more washed color pattern. Fully grown they reach an overall length of about 2 inches. In the wild, these fish exist in freshwater puddles in Southern Asia. SEX. The male will find a quiet corner of his little pond and build a nest. This nest isn't anything like the things birds construct. The male will swim to the surface and take a mouthful of air. Holding it in his closed jaws he covers it with a mucus-like substance then it is released and placed where he wants to start his love nest. He repeated this process until there are hundreds of these mucus-covered air pockets all arranged in a large floating nest. Now it is time to introduce the female. She has been kept in a separate area because the male will fight with her to the point where death might be involved. Now having made his nest he is more respective to her presents. The courtship is brief but necessary. With both parties now in a willing mood, the lovemaking begins in earnest. The male will escort his bride to a position just under the mass of bubbles. Then with all the skills of a Don Juan, he wraps his body around that of his partner. With a gentle squeeze, he forces about 10 eggs from the ripe female and fertilizes them as they leave her body. Two things are about to happen at the same time. The eggs begin to sink to the bottom and the female, because of the effects of her orgasm, does the same. Slowly she sinks locked in the thralls of the last sexual embrace she is motionless while drifting ever downward. Before she awakens from her aroused state the male must collect the eggs one at a time and place them in the bubble nest in a private air pocket all their own. This process must happen post haste because upon awakening the female will savagely hunt down the uncollected eggs and devour them, women. This squeeze-and-pop process repeated itself until the female becomes unwilling due to the absence of eggs. By now the male has deposited up to 150 eggs in the nest. The female must leave or the male will kill her. Now alone with his future family, the male stands guard until the hatching. As the young fry hatch, they inadvertently pop their air bubbles. This is something the male can't allow to happen as the newly hatched fry can't swim. Because the young need oxygen the male has to collect them as they fall and place them back in a new bubble packed with fresh air. As the fry continues to hatch the male seems to be constantly collecting and redepositing the young back into the nest. The bubble-popping thing is a constant occurrence because of the fry's need for fresh air. Tirelessly this process continues for several days until the fry becomes free swinging and can take care of themselves. Here is the real rub, starved because of his diligent fatherly efforts the dad now sees the free-swinging fry as food! What does a good dad do when he feels hungry? He eats. Crazy. I have watched this amazing thing many times. A great learning experience for kids to watch. Easy and cheap. It sort of makes you want to go out and give a stranger a good squeeze, all the while glancing down at her feet.

Now picture, and hear, the consternation and gnashing of teeth in outer darkness on the Repugnantins side, and the laughs, chuckles, and snickers on the Dems side.

I'm more worried about the fact that so many people are willing to vote for the Republicans who made of show of staring at their cellphones when the Churchill of Ukraine, Volodymyr Zelkensky made his speech in your Congress. I hope their disrespect backfires on them come the next election.

They are "supposed" to be some of the finest leaders in the country, holding office in one of the most important entities of our national government. One should expect them to hold & demonstrate the highest respect for the organizations, their positions there, AND THE PEOPLE WHO ARE TRUSTING THEM TO REPRESENT THEM. Instead, we get the total opposite from so many and they are beyond childish, disrespectful, & embarrassing, all of the time. I don't believe any of them would want to be treated in the same manner they treated President Zelenskyy, who is risking his life daily in order to preserve freedom, not just for Ukraine, but also for the rest of us. One might ask if those disrespecting him value freedom at all.....

Miland, their behavior was so rude and childish it made me wince. It also brought on an acute attack of fardo.(Back a hundred years ago, Cal Berkeley had a campus humor magazine, The Pelican. Among other things, they ran contests. One was to create words for feelings that had no word. FARDO is the feeling of being embarrassed for someone who is too stupid to be embarrassed for him/herself.)

I take it that you mean that RR would have to pay people if he used their suggested caption. One way round this might be to ask people to opt for the chance to be on a 'roll of honor' somewhere in the book in exchange for permission to use their contribution, and only include contributions from those who agree.

Fair is fair. Why should any commercial enterprise be entitled to use contributors’ work product for free? Do you work for free?

Now if he agreed to donate the proceeds to an acceptable nonprofit cause I (or others) might agree to have our contributions used for free (with proper acknowledgment).

I know of no other person in our history, who has done the damage he has done to our country and is still free to spew hate, lies and his own brand of poison and not had to pay a very high price for such actions. It is way past time to put an end to this.
